The FTC (Federal Trade Commission) as of March 1st 2012 has banned the selling of network marketing leads to it’s downlines. Although this rule does apply to other franchises and business platforms, this will and has hit the MLM community the hardest.

Network marketing opportunities have for many years built their organizations upon the selling of leads. Today that industry within the industry is now banned and halted. With the many, many complaints the Federal Trade Commission has given their undeniable and final answer, an answer you can find below.

Why were they selling leads and why were members buying? The answer is obvious, but the outcome did not pan out for most people, thus the new federal regulation. For those within the opportunities industry it is all about purchasing leads, at least that is what they were told. These leads were said to be fresh and reliable and some were, but many were not. I believe this biggest reason for failure through purchasing leads was lack of training and leadership.

There are many successful individuals within the MLM communities due to the fact of converting would-be prospects. Was taking away this part of this particular industry a GOOD ANSWER to a few abuses and misguided beliefs of those spending every dime on leads? NO! Sorry, but getting rid of this industry overnight should be an outrage to any entrepreneurial instinct in your bones!

They say that 98% of people within network marketing fail, this is true, but why? It was not because of the leads per-say, but due to a lack of training on not just closing a deal, but training on the particulars of the opportunity, products and it’s services to it’s members. Whether you are paying for prospects or generating a ton of FREE TRAFFIC online, who you are, how you come across and what you know is what closes the deal.

I truly believe the FTC has overstepped it’s grounds here, once again. Any more power to these guy’s and 2+2 will equal 5 because it is the law. Do not get me wrong, I love my country and I hate to see the “little guy” taken advantage of, but where does it stop?

One of my biggest issues with purchasing leads was not the occasional upline that was wasting the time of it’s members, but wasting their time on unqualified leads. When I was in the Insurance industry we purchased leads all the time, each and every week (this is gone too by the way). There was a difference here however, these leads were qualified as the prospect knew what they were asking for when they filled out their information.

Unfortunately with the likes of INCOMEATHOME.COM or ONLINEBUSINESSYTEMS.COM, some lead generating programs blatantly misguided people deliberately. Yes, I said it! They did and they did it well even if the company they represented did not like them, but could not stop them legally. This was the reason for the change to the lead selling laws created originally in 2006 and updated in 2008 to what you have now.

FTC Announces Final Adoption of Revised

Business Opportunity Rule

The Federal Trade Commission has announced final adoption of its long-awaited Revised Business Opportunity Rule. The new rule becomes effective March 1, 2012, following a tortured rule-making process that began almost 6 years ago.

The initial rule proposal made in April 2006 prompted a massive public outpouring of some 17,000 comments, mostly negative, and mostly from the network marketing community. This extraordinary reaction sent the FTC back to its drawing board. In March of 2008 it returned with a revised proposed rule that it said would not cover MLM companies. (See my article in Network Marketing Business Journal, May 2008, Vol.23 Issue 5, page 8).

The final rule as adopted is essentially unchanged from that 2008 proposal. It uses definitions much narrowed from the 2006 initial proposal so as to avoid generally targeting all direct selling or MLM opportunities. But it does not give direct sellers a “Get out of Jail Free” card. It does not provide either an exemption or exclusion for them. And in fact, because the new rule sets no minimum required payment threshold, its potential coverage is actually much broader than the original (and current) version of the Business Opportunity Rule.

The new rule is designed to apply to any opportunity for which there is a required payment and in which the seller offers any one of three specific types of business assistance that the FTC considers “demonstrably injurious” common features of business opportunity fraud. These three disfavored features are:

Providing actual locations for operation of vending machines, rack displays, etc. used by the purchaser in doing the business;
Providing outlets, locations, accounts or customers to facilitate the purchaser in making sales for the business;
Buying back the goods or services the purchaser makes when doing the business or providing payment for such services as, say, stuffing envelopes from the purchaser’s home.

In my experience, the first and third listed features have rarely, if ever, been part of a network marketing opportunity. On the other hand, feature #2 has frequently been included or made available in some form by MLM and direct selling companies to their participants. The FTC, recognizing that this element has the potential to affect numerous business offerings not covered by the current rule, included the following detailed description of the specific sorts of business assistance that are intended to be targeted by this element:

“Providing locations, outlets, accounts, or customers means furnishing the prospective

purchaser with existing or potential locations, outlets, accounts, or customers; requiring,

recommending, or suggesting one or more locators or lead generating companies; providing

a list of locator or lead generating companies; collecting a fee on behalf of one or more

locators or lead generating companies; offering to furnish a list of locations; or otherwise

assisting the prospective purchaser in obtaining his or her own locations, outlets, accounts,

or customers, provided, however, that advertising and general advice about business development

and training shall not be considered as “providing locations, outlets, accounts, or customers

REVISED PROPOSED BUSINESS OPPORTUNITY RULE

(c) Business opportunity means:

(1) A commercial arrangement in which the seller solicits a prospective purchaser to

enter into a new business; and

(2) The prospective purchaser makes a required payment; and

(3) The seller, expressly or by implication, orally or in writing, represents that the

seller or one or more designated persons will:

(i) Provide locations for the use or operation of equipment, displays, vending

machines, or similar devices, owned, leased, controlled or paid for by the

purchaser; or

(ii) Provide outlets, accounts, or customers, including, but not limited to,

Internet outlets, accounts, or customers, for the purchaser’s goods or

services; or

(iii) Buy back any or all of the goods or services that the purchaser makes,

produces, fabricates, grows, breeds, modifies, or provides, including but

not limited to providing payment for such services as, for example,

stuffing envelopes from the purchaser’s home.

New business means a business in which the prospective purchaser is not currently

engaged, or a new line or type of business.

Required payment means all consideration that the purchaser must pay to the seller or an

affiliate, either by contract or by practical necessity, as a condition of obtaining or

commencing operation of the business opportunity. Such payment may be made directly

or indirectly through a third-party. A required payment does not include payments for

the purchase of reasonable amounts of inventory at bona fide wholesale prices for resale

or lease.

Providing locations, outlets, accounts, or customers means furnishing the prospective

purchaser with existing or potential locations, outlets, accounts, or customers; requiring,

recommending, or suggesting one or more locators or lead generating companies;

providing a list of locator or lead generating companies; collecting a fee on behalf of one

or more locators or lead generating companies; offering to furnish a list of locations; or

otherwise assisting the prospective purchaser in obtaining his or her own locations,

outlets, accounts, or customers, provided, however, that advertising and general advice

about business development and training shall not be considered as “providing locations,

It wasn’t all that long ago that I was in the exact same spot you are right now. I was searching online for the right mentorship program. Believe me, I took my search much deeper than most people will. I looked everywhere and at just about everyone. Some that were claiming to be mentors online, ended up just being other marketers who were promoting their voice broadcasters like iBuzz Pro, Some just had less knowledge about it than I did. Another good tip, is to stay away from the “I’m gonna share my screen on skype mentors.” Listen, could you imagine someone wanting to become a surgeon and someone posing as a trainer of surgeons says to you, pay me X and I’ll share my screen with you on skype and you’ll become a master surgeon, yeah right! That aint gonna fly. I made the mistake of doing this because I was following the guy mentioned above, but then I realized the ludicrous nature of it realize how dumb that is. So avoid this as well. Now, before I move on, please don’t mistake me for saying that someone sharing their screen in and of itself is bad, as you can learn things that way, but if your “mentor” has that kind of time to spend with you, chances are you are his/her only student, humm!!! Think about it. You need a place you can login into and complete different training modules that are organized and full of rich material that you can actually learn and duplicate.

So now that I’ve given you some things to avoid, what should you look for?

1. Look for a program that is worth more than you can afford, but doesn’t actually cost that much! Remember you are investing in your education, invest well the first time!

2. Look for a program that is laid out in an easy to follow and understandable manner.

3. Look for a program that actually has a platform for you to log into, such as a members area, etc. So that you can go back at anytime you’d like and refresh your mind on things.

4. Look for a program from a reputable trainer, not some guy with smooth speech on youtube, trying to sell you a “voice broadcaster” but calling it a mentorship program.
